Committee membership/ election of a Chair

Minutes:

The Democratic Services Officer confirmed that the Sub-committee would comprise Councillors Fahmy, Jeffree and Scudder.

 

          The Sub-committee was asked to elect a chair for the hearing.

 

          RESOLVED –

         

          that Councillor Joe Fahmy be elected chair for the hearing.

Disclosure of interests (if any)

Minutes:

There were no disclosures of interest.

Exclusion of Press and Public

The Chair to move: that, under Section 100A (4) of the Local Government Act 1972, the public and press be excluded from the meeting for the following item of business as it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during consideration of the item there would be disclosure to them of exempt information as defined in Section 100(1) of the Act for the reasons stated below in terms of Schedule 12A.

 

Note: if approved, the Chair will ask members of the press and public to leave the meeting at this point.

RESOLVED –

Application for new Personal Licence

Report of Senior Licensing Officer

 

This report contains exempt information pertaining to an individual.

Minutes:

The committee received a report from the Senior Licensing Officer including representations from the Hertfordshire Constabulary. 

 

          The Senior Licensing Officer highlighted key aspects of the report.  The applicant addressed the committee and Sergeant Luke Mitchell of Hertfordshire Constabulary presented Hertfordshire Constabulary’s representation.  All parties were given opportunity to speak to the sub-committee and to respond to questions from those present.

 

          The Sub-committee retired to consider its decision.

 

 

20.

Decision of Sub-Committee

Minutes:

On the Sub-committee’s return, the chair announced the decision.

 

RESOLVED –

 

          that having heard the evidence from the applicant and the representations from the police, the sub-committee has made the decision to refuse the application             for a personal licence, as it would undermine the licensing objective of crime and disorder. The applicant failed to demonstrate an understanding and appreciation of his responsibilities under the crime and disorder objective of the Licensing Act.

 

          In reaching this decision the sub-committee has taken into account the provisions of the Licensing Act 2003 and the  Secretary of State’s Guidance (April 2018).
